PROCESS DESCRIPTION
The O'Bryan & O'Bryan team will invite you to a meeting to discuss your case and to design a roadmap to achieve the services you're requesting. At our law firm, there are typically 5 phases to resolve probate in SC. These phases include an initial meeting, submitting legal documents for a probate court petition, attorney and estate executor/personal representative collaboration meeting to cover records, wills, titles, etc., probate court filing period, and lastly the completion of probate with the final court order.
For estate planning of Wills, Trusts, POAs, and Heath Care Directives O'Bryan & O'Bryan makes things easy with one well documented meeting to cover all needs and wishes before documents are drafted, approved, finalized, and mailed to you.
Each county has a Probate Judge who is popularly elected to a four-year term and has jurisdiction over marriage licenses, estates of deceased persons, guardianships of incompetents, conservatorships of estates of minors and incompetents, minor settlements under $25,000 and involuntary commitments to institutions for mentally ill and/or chemically dependent persons. They also have exclusive jurisdiction over trusts and concurrent jurisdiction with Circuit Courts over powers of attorney.
